Cleaning products as well as garbage bags are on site. Unit has to be clean when left, all garbage has to be removed from premise and disposed by lessee. All lights have to be turned off when leaving, if any appliance had been used, they have to be turned off and left clean. All tables and chairs have to be clean and brought back to their storage place. There is no smoking or vaping on premise. You are also fully responsible for any damages caused during your booking time and liable thereof. All units are equipped with cameras and are recorded for your protection as well as ours.

All bookings have to be paid in full one week prior date by e-transfer, there will be no refund for cancellation. Secret entry-code given is your responsibility and liability.

RELEASE OF LIABILITY, WAIVER OF CLAIMS

AND ASSUMPTION OF RISKS AGREEMENT (hereinafter referred to as the “Release Agreement”)
BY SIGNING THIS DOCUMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT. PLEASE READ CAREFULLY!

To: Dachlauer Investments Ltd. and its directors, officers, employees, instructors, agents, representatives, volunteers, independent contractors, subcontractors, successors , assigns and representatives. (the “Releasees”).

DEFINITIONS:
In this Agreement, Short-Term Rental Space shall include the approximately 1,000 square foot space located at 215 Tenth Street in Hanover, Ontario or the approximately 1,400 square foot space located at 211 Tenth Street in Hanover, Ontario or the commercial kitchen located at 211 Tenth Street in Hanover, Ontario, or any combination thereof, as set out in the Short-Term Rental Agreement between myself and Dachlauer Investments Ltd.;

ASSUMPTION OF RISKS
I hereby agree that I am renting, operating or using the Short-Term Rental Space provided by Dachlauer Investments Ltd. at my own risk. I agree that I am voluntarily participating in all activities related to the rental, operation, or use of the Short-Term Rental Space, and assume all risk of injury, illness, damage or loss that might result, whether to myself or any third party, including, but not limited to any guests I may have, even if the risks arise out of the negligence or fault of the Releasees.
RELEASE OF LIABILITY AND WAIVER OF CLAIMS
In consideration of the Releasees permitting my use of the Short-Term Rental Space, and for accepting my application to rent the Short-Term Rental Space, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows:

TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may s uffer resulting from either my use of the Short-Term Rental Space, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE UNDER THE OCCUPIERS’ LIABILITY ACT, RSO 1990, c.02 ON THE PART OF THE RELEASEES, AND ALSO INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS REFERRED TO ABOVE;

This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;

This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be gover ned by and interpreted solely in accordance with the laws of the Province of Ontario and no other jurisdiction; and

Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of Ontario and sha ll be within the exclusive jurisdiction of the Courts of the Province of Ontario.

I AGREE TO HOLD HARMLESS AND TO INDEMNIFY THE RELEASEES from any and all liability from property damage and personal injury to any third party, including, but not limited to any guests I may have, resulting from my use of the Short-Term Rental Space and it’s facilities; AND THAT, t his Release of Liability shall be effective and binding upon my heirs, next of kin, executors, administrators, and assigns may have against the Releasees.

I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
